Case 1: Mitch’s leather jacket
Mitch takes his expensive leather jacket to be expertly dry cleaned.
Dan the Dry Cleaner tells Mitch that the cleaning might damage the zipper and metal studs on the jacket, due to the chemicals and heat used in the dry-cleaning process.
Mitch accepts this, and is asked to sign a document, which Dan says excuses the cleaner from any liability concerning the zipper and
metal studs. Mitch signs the document without reading it.
Mitch is horrified to discover, when he collects the jacket, that it has been totally ruined by the dry cleaner, and that they are seeking to rely on the terms of the document he signed, which completely exempts them “from any legal responsibility whatsoever”, for damage caused to clothing.
Advise Mitch if he has any legal rights against Dan the Dry Cleaner.
